End User License Agreement (EULA) for Botanical Sciences’ Relief Points Program

Effective Date: August 1, 2023

Introduction

This End User License Agreement (“EULA”) governs the use of the software, mobile application, website, and other services associated with the Relief Points Program (“Program”) offered by Botanical Sciences (“Company,” “we,” “us,” or “our”).

By accessing or using any part of the Program, you (“you,” “your,” or “End User”) agree to comply with and be bound by this EULA. Please read this EULA carefully before using the Program.

License Grant

Subject to the terms of this EULA, Botanical Sciences grants you a non-exclusive, non-transferable, and revocable license to access and use the Program for personal, non-commercial purposes.

Restrictions

You agree not to:

  1. Reverse engineer, disassemble, or attempt to discover the source code of the Program.
  2. Sell, sublicense, or redistribute any portion of the Program.
  3. Use the Program for any purpose that is illegal or prohibited by this EULA.

User Account

  1. To participate in the Program, you must create a user account (“Account”).
  2. You are responsible for maintaining the confidentiality and security of your Account.
  3. Botanical Sciences is not liable for any loss or damage resulting from unauthorized access to your Account.

Intellectual Property

All intellectual property rights in and to the Program, including but not limited to code, graphics, sounds, and copyrights, are owned by or licensed to Botanical Sciences.

Termination

  1. This EULA is effective until terminated by either party.
  2. You may terminate this EULA by ceasing all use of the Program and deleting all copies thereof.
  3. Botanical Sciences may terminate this EULA at any time for any reason, including but not limited to, breach of any term of this EULA.

Disclaimers

  1. The Program is provided “as is” and “as available” without any warranties of any kind, either express or implied, including but not limited to, the implied warranties of merchantability, fitness for a particular purpose, or non-infringement.
  2. Botanical Sciences does not warrant that the Program will be uninterrupted, secure, or error-free.

Limitation of Liability

In no event shall Botanical Sciences be liable for any indirect, incidental, special, or consequential damages arising out of or in connection with the Program or this EULA.

Governing Law

This EULA is governed by the laws of the State of [Your State], without regard to its conflict of laws principles.

Amendments

Botanical Sciences reserves the right to modify this EULA at any time. Changes will be posted on our website, and the “Effective Date” will be updated.
